PLEASE NOTE THAT THESE ARE 'STANDARD' CONTRACTS WHICH ARE SUITABLE FOR THE MAJORITY OF DESIGN PROJECTS. HOWEVER,  BESPOKE CONTRACTS ARE AVAILABLE FOR MORE IN-DEPTH PROJECTS WITH DIFFERENT TIMESCALES | REQUIREMENTS. THIS WILL BE DISCUSSED AT OUR CONSULTATION & TAILORED TO SUIT BOTH OF US.

WEBSITES

 

This website design agreement is made between the _____________ (client completing the form) located at ________ (your business address) and Claire Fisher at The Design Witch (web designer) on _______(date of the completed form) to design and develop a website.

 

*Estimated Design Start Date: will be sent to you via email and all the terms and conditions below will be based on that date going forward. This date would be agreed by both parties prior to contract.

 

1. Services

 

The web designer will complete the following services:

  • Have a consultation either face to face | by FaceTime or telephone with the client to establish their requirements. A quotation will be sent and agreed with a specification of their requirements. The web designer will then send a list of content required for the website build for the client to complete and return by the agreed date* above.

  • Open a website hosting account if applicable

  • Look into domain names if applicable

  • Design and Build will begin. One page (normally the ‘home’ page) will be initially designed to make sure the client is happy with that design, once agreed the same design will be added throughout the website. If at a later time the client decides the design needs to be changed, additional charges may apply.

  • Complete basic SEO

  • Connect to Google to the clients existing google account

  • Make the website LIVE

  • The service will include 2 revisions. This is the scope of the work the parties agree upon. For changes or additional requirements a change order would need to be completed and agreed by both parties. Additional requirements will be priced accordingly.

  • Once the project is complete the client will receive a hand over pack from the web designer.

2. Costs and Payments

​

  • The Web Designer will charge the agreed amount for the services mentioned above at a fixed price. The agreed amount will be in an email for both parties to agree.

  • A non refundable deposit is due before the project begins.

  • If the project isn’t completed within 4 weeks of the start date*, due to the client not providing some of the relevant content to go any further, there will be a middle payment required to be paid by the client. This will of course be deducted from the final amount.

  • The outstanding website payment is due when your site is completed | is ready to go live | or is live. An invoice will be sent and payment will need to be made within 7 days.

  • Once your website is signed over to you, this is for you to maintain and update. If you need me to do this in future, small edit fees will apply.

 

3. Schedule

Preliminary Design

The web designer will aim to have the preliminary design | draft for approval within 4 weeks of the estimated start date* above. Please note this may not have all of the relevant pages & information required for the end product, but this would be the initial design.

 

Review of the Second Stage Design

The web designer will aim to have the website ready within 6 weeks of the approved preliminary design. The completed website will be sent to the client to review at this stage.

 

Final Review

The Final changes will be made within 4 weeks of receiving them from the client.

The Client will have 5 business days to review and approve each step. At the end of said time, if no answer has been given, the work will be considered approved, and the web designer will continue their work. And as stated above, once final changes have been made a final invoice will then be generated for payment within 7 days of the invoice.

 

Unforeseen Circumstances

If the client experiences unforeseen circumstances that holds up getting information in time to the web designer, an email would be required along with payment for any work already completed by the web designer up to that point.

In the unlikely event of the web designer experiencing any unforeseen circumstances and puts a hold on any projects, they will contact the client as soon as possible and a new agreement will be put in place.

 

4. Termination of Contract

 

This agreement will automatically terminate when both Parties have performed all their obligation under the Agreement and all payments have been made.

Should there be a desire to terminate the agreement before the completion of the project, the client will notify the web designer 7 days in advance, and pay for services already completed and for hours already worked.

 

5. Limitation of Liability

 

Neither party will be liable for breach-of-contract damages that are remote or speculative, or that the breaching party could not reasonably have foreseen on entry to this agreement.

 

6. Intellectual Property

​

The client will own the website and any visuals provided by the web designer. The web designer will turn over all necessary files.

The client guarantees that they have legal rights to all elements of text, photographs, and anything else that they provide the web designer with , and will not hold the web designer responsible for any third party claims.

 

7. Dispute Resolution

​

If either party accuses the other of being in breach of contract, the accused party will have 30 days to address the breach.

GRAPHIC DESIGN / LOGOS: 

​

Consultations are available face to face, by telephone or online. These are very important. This gives me the chance to completely understand what you are looking for, the sytle you want, the colours, the feel etc.

Logo Design

​

  • Non refundable deposits are taken prior to commencing desgin work on LOGOS.

  • The outstanding graphic design fee on logos is due when the final proof is agreed. An invoice will be sent and payment will need to be made within 7 days.

  • Once final payment is received I will release the artwork to you for you to use as you wish.

Brochures | Flyers | Business Cards | Signs | Banners | Vouchers | Price Lists | Any other design work

 

Full payment is required on these projects prior to design work commencing. This includes a reasonable amount of changes and tweaks to make it perfect for you. Anything beyond this may incur extra charges. I will always keep you up to date via email if I feel you may incur extra charges.

 

Logos and All Graphic Design Projects

 

Any printing costs are quoted separately to design fees.

Timescales on creating your designs all vary. This can depend on the quantity of work, your individual requirements and how long it takes for you to provide me with all the information needed to go forward. We can discuss this at our consultation.

If the project goes on longer than anticipated a half way fee may apply, which will in turn lower the final fee.

If during the design process you have additional requirements, this will incur additional fees.

I am happy to make a 'reasonable' amount of tweaks to your designs. If this goes above 5 small changes, there may be additional charges. I will always keep you informed every step of the way. First proofs and drafts will be sent to you for approval / changes. You will be given ample opportunity to give me your feedback / changes and tweaks. Once this happens & payment is up to date, the designs are yours to keep - if you decide after this time you would like further changes, small edit fees will apply.

 

The Client will have 5 business days to review and approve each step. At the end of said time, if no answer has been given, the work will be considered approved, and the web designer will continue their work.
